StuntIQ Terms of Service

1. Agreement to Terms

By accessing or using StuntIQ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of an organization (such as a gymnastics gym, cheerleading program, or athletic team), you represent that you have authority to bind that organization to these Terms.

These Terms are in addition to the Closed Beta Participation Agreement, which also applies during the current beta period.

2. Description of the Service

StuntIQ is an AI-powered sports video analysis platform that allows gym administrators, coaches, and athletic organizations to:

• Upload videos of athletic performances (primarily cheerleading stunts)
• Receive automated AI analysis including stunt detection, phase classification, difficulty scoring, and error detection
• Access visualization overlays and analysis summaries
• Contribute to the improvement of sports AI models

The Service is currently in closed beta. Access is limited to organizations approved by SkillGrade Labs LLC.

3. Eligibility and Beta Access

3.1 Account Eligibility

To use the Service, you must:

• Be at least 18 years old
• Have authority to represent the gym, team, or organization you register
• Have received an invitation or approval from SkillGrade Labs LLC for beta access
• Provide accurate registration information

The Service is not intended to be accessed directly by minor athletes. Minor athletes participate through the videos uploaded by adult account holders (coaches, gym administrators).

3.2 Beta Access

Access to StuntIQ during the closed beta is by invitation only. SkillGrade Labs LLC reserves the right to grant, restrict, or revoke beta access at any time at its sole discretion.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy.

You specifically agree NOT to:

• Upload videos that you do not have the right to share (e.g., videos of people who have not consented to being recorded or to AI analysis)
• Upload videos containing individuals for whom you have not obtained appropriate consent or parental/guardian authorization where required
• Upload content that is abusive, harassing, or that violates any person's privacy or rights
• Attempt to reverse-engineer, extract, or reproduce the AI models or proprietary algorithms powering the Service
• Use the Service for any purpose other than legitimate sports analysis and training
• Share your beta access credentials with unauthorized parties
• Attempt to circumvent beta access restrictions, rate limits, or security controls

5. Video Content and Data

5.1 Your Content

You retain ownership of the videos you upload. By uploading videos to StuntIQ, you grant SkillGrade Labs LLC a license to:

• Store, process, and analyze the video through our AI pipeline
• Display analysis results to you within the platform
• Use the video content, AI-derived features, and analysis outputs for the purposes described in our Privacy Policy and AI Training Disclosure, including improving our AI models

5.2 Your Responsibilities

You represent and warrant that:

• You have the right to upload and share all videos you submit to the Service
• All individuals depicted in uploaded videos have consented (or their parents/guardians have consented) to video recording and AI analysis
• Your use of the Service complies with all applicable laws, including laws governing data collection related to minors (e.g., COPPA)
• You have reviewed our Youth Athlete Media Policy and will comply with its requirements when uploading videos containing minor athletes

5.3 Video Content We Process

The Service processes uploaded videos using an automated AI pipeline. This pipeline analyzes the video to identify people, track their movements, extract body pose data, classify athletic roles and stunt phases, and score performance. See our AI Training Disclosure for full detail.

6. AI Analysis — Disclaimers and Limitations

The AI analysis outputs generated by StuntIQ are experimental and provided for informational purposes only.

6.1 Beta Status

During the closed beta:

• All AI results are labeled "Beta – Experimental"
• Model accuracy and completeness are not guaranteed
• AI outputs may contain errors, omissions, or inaccuracies
• Features and outputs may change between beta versions without notice

6.2 Not for Safety-Critical Decisions

AI outputs from StuntIQ, including but not limited to error detection flags, difficulty scores, and phase classifications, must not be used as the sole basis for safety decisions affecting athletes.

Coaches, gym administrators, and athletic directors remain solely responsible for athlete safety decisions. AI-generated error detection does not replace qualified human coaching judgment.

SkillGrade Labs LLC expressly disclaims any liability for athlete injury, harm, or adverse outcome resulting from reliance on AI analysis outputs.

6.3 No Accuracy Guarantee

SkillGrade Labs LLC makes no representations or warranties about the accuracy, completeness, or fitness for purpose of AI analysis results. Results are based on probabilistic machine learning models and reflect the quality of available training data.

7. Privacy and Data

Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to the data practices described therein.

8. Intellectual Property

8.1 StuntIQ IP

All software, AI models, algorithms, schemas, visualizations, and platform infrastructure are the intellectual property of SkillGrade Labs LLC. Nothing in these Terms grants you ownership of or license to any StuntIQ technology beyond the right to use the Service as described.

8.2 Your IP

You retain all intellectual property rights in the videos you upload. You grant SkillGrade Labs LLC the licenses described in Section 5.1.

9. Account Termination

9.1 Termination by You

You may request that we close your beta access at any time by contacting us. The current beta does not provide a separate self-service account-wide deletion workflow. If you need a specific uploaded video removed, use the specific-video deletion or consent-revocation process described in our Data Retention and Deletion Policy.

9.2 Termination by SkillGrade Labs LLC

We may suspend or terminate your access to the Service at any time if you violate these Terms, misuse the platform, or if the beta program ends.

10. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• SKILLGRADE LABS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• SKILLGRADE LABS LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE
• SKILLGRADE LABS LLC'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR $100 IF YOU HAVE NOT PAID)

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms as the platform evolves. We will notify you of material changes by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
